Terms and Conditions
These Terms and Conditions govern purchases made from MY NEXT SOFA LTD through https://mynextsofaonline.co.uk, by telephone, in our showroom or through another sales channel where these terms are incorporated into the order. Please read them before placing an order.
1 About us
We are MY NEXT SOFA LTD, a company registered in England and Wales under company number 16715449. Our registered office is 95 Bradley Boulevard, Huddersfield, HD2 1EA. Our showroom is at Unit 8, Bessemer Way, Adams Road, Workington, CA14 3YS. You can contact us at info@mynextsofaonline.co.uk or +44 7350 092214.
2 Who these terms apply to
These terms apply to consumers purchasing goods for personal use. If you are purchasing wholly or mainly for business purposes, please contact us because separate business terms may apply.
You must be at least 18 years old and legally capable of entering into a contract to place an order.
3 Products
We sell sofas, sofa beds, armchairs, beds, mattresses, dining furniture, accessories and related furniture products. Some goods are held in stock, while many upholstered products are made after the order is accepted.
The product page and order confirmation identify the model, dimensions, configuration, orientation, fabric, colour, quantity and any other options included in your order. Please check all of these details carefully before submitting the order.
4 Images, colours, fabrics and natural variation
We take reasonable care to display products accurately. Images are illustrative and colours can look different because of screen settings, lighting, photography, fabric batch and the direction of the pile. Natural materials and handmade upholstered products may show minor variations in colour, grain, texture, stitching and finish.
If colour or texture is important, we strongly recommend ordering a fabric sample before placing the furniture order. A sample is indicative; a later production batch may show a small variation.
5 Dimensions, orientation and access
Furniture dimensions are approximate. Upholstered and handmade products may vary slightly from the published measurements because of the materials and manufacturing process.
For a corner or chaise product, left-hand or right-hand orientation is determined while standing in front of the furniture and looking at it, unless the product page expressly states otherwise.
Before ordering, you are responsible for checking that the product will fit in the intended room and can pass safely through all external and internal access points, including gates, paths, doors, corridors, lifts, staircases, landings and turns. You must tell us before delivery about restricted access, parking restrictions, upper floors, narrow stairways or other relevant conditions.
We can provide product dimensions and general guidance, but you remain responsible for your measurements unless we have provided a separate written measuring service that expressly accepts responsibility for them.
6 Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. Delivery or other optional service charges are shown at checkout or agreed with you before the order is accepted.
We accept the payment methods displayed at checkout. Third-party payment services, including card processors, PayPal and any retail finance provider, may apply their own terms and eligibility checks.
If a price or product description contains an obvious error, we may reject or cancel the affected order and refund any amount paid. We will contact you and, where possible, offer the option to order at the correct price.
7 Placing an order and contract formation
Submitting an order is an offer to buy the goods. An automated acknowledgement confirms receipt but does not necessarily mean that we have accepted the order.
The contract is formed when we send a written order acceptance or otherwise expressly confirm that the order has been accepted. We may decline an order before acceptance, for example because a product or material is unavailable, payment has not been authorised, delivery is not available to the address, a finance application is not approved, or the product or price information contains an error.
Please contact us immediately if the order confirmation is incorrect. Changes may affect price and delivery time and are not effective until confirmed by us in writing.
8 Stock and made-to-order products
A stock product is an item identified as in stock or express delivery at the time of ordering. A made-to-order product is manufactured after we accept the order using the model and standard options selected by the customer.
A customised product is made to the consumer’s specifications or is clearly personalised, for example by using non-standard dimensions, a non-standard combination or another individual specification that is not offered as a normal product option.
Made to order does not automatically mean customised. The cancellation rules below depend on the actual specification of the goods and not only on the label used on the website.
9 Changes and cancellation before delivery
Contact us as soon as possible if you want to change or cancel an order. For stock goods, we will normally accept cancellation before dispatch and issue a refund.
For made-to-order goods, we will normally accept changes or cancellation before production begins. Once production has begun, a requested change may be impossible or may involve reasonable additional costs that we will explain before proceeding. This commercial arrangement does not restrict any statutory cancellation right that applies to an eligible distance-sale order.
Where goods are genuinely customised, the statutory right to cancel for a change of mind may not apply. This does not affect rights relating to faulty, damaged, misdescribed or incorrectly supplied goods.
10 Delivery
The delivery method, charge and estimated timeframe are shown on the product page, at checkout, in our Delivery Policy or in the written quotation. An estimate is not a guaranteed date unless we expressly agree a fixed delivery date in writing.
Stock products are normally delivered within 1 to 7 working days. Made-to-order furniture is normally delivered within 4 to 8 weeks. In exceptional circumstances, such as material shortages or transport disruption, delivery may take up to 12 weeks. If a material delay occurs, we will contact you and explain the available options.
We deliver only to addresses we have agreed to serve. Additional charges or different service levels may apply to remote locations, islands, Northern Ireland, restricted-access properties or areas outside our normal delivery routes.
You must provide accurate contact and delivery details and ensure that an adult aged 18 or over is present. Unless otherwise agreed, you must provide safe and reasonable access, clear the route and protect fragile flooring or belongings.
11 Failed or unsafe delivery
We may stop or refuse a delivery where our team reasonably considers the access or working conditions unsafe, unlawful or likely to cause damage. We will discuss alternative arrangements where reasonably possible.
If delivery fails because nobody is present, the address is incorrect, access was not disclosed or the premises are not ready, we may charge the reasonable direct cost of storage and redelivery. We will tell you the charge before arranging another delivery. A redelivery charge will normally be at least £100 for large furniture.
If goods do not fit because the access route or room was measured incorrectly, we will discuss reasonable options. Dismantling, return, storage or redelivery may incur an additional charge.
12 Delivery service and assembly
For eligible upholstered furniture, white glove delivery normally includes delivery to the agreed room, unpacking, basic assembly where required and removal of transit packaging. Flat-packed furniture, third-party courier deliveries and some remote-area deliveries may be doorstep only. The service applicable to your order will be confirmed before delivery.
Delivery staff are not required to remove doors, windows, banisters or existing furniture, connect electrical or gas equipment, carry out building work, or move items where it would be unsafe to do so.
13 Inspection and delivery damage
Please inspect the goods as soon as reasonably possible. If you notice visible damage, missing parts or an incorrect item, tell the delivery team and contact us promptly with the order number and photographs where possible.
Signing a delivery record confirms receipt and does not remove your statutory rights. A failure to identify a hidden defect immediately does not prevent a valid later claim.
14 Ownership and risk
Responsibility for loss or damage passes to you when the goods are delivered to you or to a person identified by you to receive them. Ownership passes when we have received payment in full, including any amount paid by an approved finance provider.
15 Right to cancel after delivery
For an eligible distance-sale order, you normally have 14 days from the day after delivery to tell us that you wish to cancel without giving a reason. Where an order contains several items delivered on different days, the period normally runs from the day after the final item is delivered.
This change-of-mind right does not apply to goods made to your specifications or clearly personalised, or to another category excluded by law. It does not limit your rights if goods are faulty, damaged, misdescribed or not supplied as agreed.
To cancel, send a clear statement to info@mynextsofaonline.co.uk or to our registered office. You may use the model cancellation form in our Returns and Refunds Policy, but you do not have to use it.
16 Returns and refunds
You must take reasonable care of goods while they are in your possession. You may inspect them as you would reasonably be permitted to do in a shop, but we may make a lawful deduction if handling beyond that causes a reduction in value.
Unless the goods are faulty or we agree otherwise, you are responsible for the direct cost of returning them. Large furniture must normally be collected by a suitable insured two-person service. If we arrange collection, the estimated charge for standard delivery zones is normally between £100 and £219, depending on the zone, floor and service required. Red Zone and special-location collections require a quotation. We will confirm the charge before collection.
For an eligible cancellation, we will refund the price and the cost of the least expensive standard delivery option offered for the order. We may withhold the refund until the goods are returned or you provide acceptable evidence of return. Refunds are made to the original payment method within the period required by law.
17 Faulty, damaged or misdescribed goods
Goods must be of satisfactory quality, fit for any purpose made known to us and match their description. If they do not, you may have rights to reject, repair, replacement, price reduction or refund under the Consumer Rights Act 2015.
Contact us promptly with the order number, a description of the issue and photographs or video where useful. We may inspect the goods or arrange a technician visit before agreeing the appropriate remedy. Nothing in these terms limits your statutory rights.
18 Manufacturer warranty
Unless the product page or written order confirmation states a longer period, new furniture includes a two-year manufacturer warranty against manufacturing defects. The warranty begins on delivery and is in addition to, not a replacement for, your statutory rights.
The warranty does not cover normal wear, accidental damage, misuse, neglect, commercial use, pet damage, staining, fading caused by sunlight, fabric pilling within normal tolerances, failure to follow care instructions, or unauthorised alteration or repair.
19 Retail finance and third-party payment products
Where retail finance is available, it is provided by an identified third-party lender and is subject to application, status, affordability, lender approval and the lender’s terms. We do not make the lending decision.
A furniture order funded through retail finance is not accepted until the finance application has been approved and we have confirmed the order. The finance agreement is separate from these sale terms, although statutory connected-lender rights may apply.
The applicable finance provider, product information, regulatory disclosures, eligibility conditions and credit terms will be displayed before you begin an application and before you enter into a finance agreement.
20 Our liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of your statutory consumer rights.
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, business loss arising from a consumer purchase, or delay caused by an event outside our reasonable control where we have taken reasonable steps to reduce the effect.
21 Events outside our control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, transport interruption, supplier or material disruption, industrial action, fire, flood, epidemic, government restriction or failure of utilities. We will contact you, take reasonable steps to minimise the effect and explain your options if the delay becomes substantial.
22 Privacy
We process personal information in accordance with our Privacy Policy. Payment providers and finance providers process information under their own privacy notices.
23 Complaints
Please send complaints to info@mynextsofaonline.co.uk, telephone +44 7350 092214, or write to our registered office. Our Complaints Policy explains how we handle product, service and finance-related complaints.
24 Changes to these terms
We may update these terms from time to time. The version applying to an order is the version provided or made available when the order is placed, unless a change is required by law and must apply earlier.
25 Governing law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom where you live. Nothing in this clause removes mandatory consumer protections applicable to you.
